The Terms and Conditions (hereinafter, “Terms” or “Contract”) MATT refer to the contract that is celebrated between the users of the page and us, MATT SAS BIC, a commercial company identified with NIT 901.492.626 with address in Medellín Colombia (hereinafter "We" or the "Company"). This contract regulates the access of Users to the website, its content and the provision of its services.

These Terms apply to the Users of the website including its visitors, whether they have registered or not. When any person accesses, browses and/or uses this web page, it will be understood that they have read, understood and have given their sign of acceptance and conformity with these terms and conditions, which they undertake to comply with in their entirety.

We reserve the right to modify these Terms and Conditions at any time, so we recommend that you consult them constantly. In case of making modifications that affect the rights or obligations of the Users, we will communicate it in a timely manner according to the means of communication that we have enabled on the platform.

This website is only available to people who have the legal capacity to contract. People who do not have that capacity or who have been temporarily suspended or permanently disabled, for having breached these Terms and Conditions, may not use the services. 

As a general rule, it is understood that they have the capacity to hire people who have reached the age of majority with full use of their mental faculties.  

Although there may be additional restrictions due to the country in which the Users are located, on this platform we will take 18 years as the minimum registration age. 

Minors may use the platform from the age of 14 with the permission of their legal representatives, who will be responsible for all acts of the minor. However, it is possible that to access certain services, view and interact with certain content, we must require a certain minimum age. 

When a User cannot access any service or any functionality of this platform, due to their age, this cannot be interpreted as a breach in the provision of our services, but on the contrary, control will be established to protect community.  

In order to use this website and our services, all Users must read, understand and accept these Terms and Conditions and our Personal Data Processing Policy.

The terms may be translated into various languages, but the original terms will always be in Spanish and will be available within this web page. In case there are differences in meaning between the Spanish version and a translation, the Spanish version will prevail. In case of any conflict, only the terms in Spanish will apply.

At MATT we sell different kinds of products and services. An open catalog of all our products will be available on the website so that buyers can verify the price-quantity relationship, indicating the total price that the buyer would pay. These prices are displayed with taxes included and without the price of shipping included unless otherwise expressly indicated in the product description.

Users who are interested in buying will be able to view the products along with their brand, size, color and price, and any other characteristic that is relevant to make the purchase such as size, weight, measurement, the material from which it is made, its nature, origin, components, uses, form of employment, properties, quality, suitability, quantity, or any other pertinent factor. Later they can select them and send them to the "shopping cart" where they can see all the products to buy and, before going to the payment, they can validate the value of the shipment according to the city to which the product is sent. Later, as a consumer, you can continue with the payment process, where you must provide the billing details and complete the transaction.

In the particular case of adding MATT Experiences to the cart, you will be presented with the corresponding contract before going to checkout. Once you sign it, you can proceed to complete the transaction. 

Once the purchase has been completed, as a consumer you will receive a notification to your email with the details of your purchase. In the event that there has been an error in the transaction, as a consumer you will be informed by the email registered at the time of purchase. 

6.1. Origin of the products: The items offered on the site are manufactured by third parties inside and outside of Colombia and in each case the brand or trade name of the original manufacturer will be displayed.

6.2. Options: to buy certain products it is necessary that as a consumer you choose the color, size, number of people or any other relevant characteristic of the same. Thus, as a buyer you can rely on the description of the specific product and use the table of measurements, as well as any other element that we make available to you in the description of the product.

6.3. Images: On this web page we have tried to include images of the products that are as close to reality as possible, evidencing as many details of each product in terms of textures, colors, size, seams, among others. However, the color of the products may vary due to factors such as light, the screen on which they are displayed, among others; therefore, these photographs should be taken as reference images and may not correspond exactly to reality.

6.4. Perfection of the contract and availability of the product: when as a consumer you intend to buy a product on our website, what is intended is to conclude a sales contract by electronic means. This contract is perfected when we (MATT SAS BIC) accept and confirm the purchase offer presented by you, as a consumer of the product or service.  

When as a consumer you intend to purchase more than 15 products from different categories or more than 5 products from the same reference and class, we can cancel the order, in order to prevent purchases for resale. The products offered on this website are for personal use. 

When we reject a sale, we will let you know unequivocally through a text message, an email or a call and we will proceed to refund any kind of money that we have received in a maximum term of 15 business days. In the event that third-party banking entities intervene, we do not assume responsibility for the delays that the financial institution may have, but we will keep you informed of our management.

Unless the legend "Out of stock" is found in the description of a product, it is presumed available. However, as a consumer you should know that there is a period of verification and acceptance of transactions by the different financial entities that participate in the payment process, and that your order will only be set aside or reserved once the respective acceptance has been managed. payment, by the entity where the payment was made. It is possible that during this period of time the inventory of the respective product is exhausted. When this happens, we are going to propose different forms of settlement; It will always be your right as a consumer to fully refund your money. Said reimbursement of funds will be made taking into account the return terms of the financial entities involved in the transaction.

Prices: The prices of the products and services will be in Colombian pesos and correspond to the unit price of each product together with the corresponding taxes unless expressly indicated otherwise. As a general rule, they do not include the price of shipping. When there are promotional prices or any type of incentive related to the price, we will communicate the additional terms and conditions of the promotions.

6.6. Shipments: We ship exclusively within the Republic of Colombia, with the help of a third party dedicated to this activity. As a consumer you must bear in mind that when you buy on our website your products will be packed and presented in a plastic bag, cardboard box or any other element that allows the proper conservation of the product.

The shipments will take place in the cities and regions of the country where said third party has a presence; it is possible that certain sales cannot be completed due to the place of destination. The shipping time is from 2 to 10 business days after the verification of the transaction, unless circumstances occur that prevent the free operation of national transit, in which case we will inform you in a timely manner of possible delays in your order. 

6.7. Delivery: It is your obligation as a consumer to review your order immediately after delivery. In the event that you detect that the packaging of your order is tampered with or damaged, you must open it and verify the status of the order in the presence of the collaborator of the transport service company. In the event that you find any damage, you must notify such official and contact us within the legal term to demand the reversal of the payment as will be explained later. 

If the delivery of the order is delayed: because you as a consumer refuse to receive it without just cause, or due to the inability of the company providing the transport service to find the address that has been provided in the wrong way by the consumer, and After two (2) weeks delivery has not been achieved, we (MATT SAS BIC) can claim the order and notify the consumer of this situation so that they pay again for the shipment of the products. 

 

6.8. Payment methods: our web portal has displayed the means of payment accepted by us. At MATT SAS BIC we do not directly manage payment platforms, so you as a consumer and online buyer must study and accept the use policies of said third parties.  

As a consumer you should know that internet purchases may eventually present security flaws and even when we make a secure connection system available to the consumer for all transactions, in no case will we be responsible for any failures that may occur, unless the law expressly states otherwise.

6.9. Origin of funds and illicit activities: As consumer and user of our products and services declare and guarantee:  

That Your income and especially the funds that you will use to carry out transactions on the Platform and in favor of MATT come from lawful activities.

That you are not reported on binding lists such as OFAC, the United Nations, the European Union, the HM Treasury List, the Global Control List (GEL) or on any national or international money laundering prevention list.

That you do not participate, nor are you immersed in investigations, judicial or police reports for crimes such as money laundering, drug trafficking, human trafficking, pimping, child pornography, embezzlement, concussion, kidnapping, extortion, membership and/or dealings with organizations illegal armed groups or with criminal organizations of any kind, arms trafficking, terrorism, crimes against humanity or crimes against freedom, integrity and sexual education. 

That you have not given a third party bank information, which could be used to make purchases or acquire obligations in your name.

In the event that as a consumer or user you are involved in such situations, this contract and any other that is in progress will be terminated, without this generating any type of compensation in favor of you as a Consumer. 

6.10. Invoice: the sales invoice will be issued and sent in electronic format to the email with which you as a consumer registered on the Portal to make the purchase, through a provider authorized by the National Tax and Customs Office (DIAN).

6.11. Right of Withdrawal: In the sales processes carried out through the Platform, the right of withdrawal will be understood to have been agreed. In this event, the contract will be terminated and we (MATT SAS BIC) will refund the money that you would have paid as a consumer, with the following conditions: 

As a consumer you must return the product by the same means and in the same conditions in which you received it. Transportation costs and others involved in returning the good will be covered by you as a consumer.

The maximum term to exercise the right of withdrawal will be five (5) business days counted from the receipt of the products.

Does not apply to products for personal use.

The product must be in perfect condition. 

We will return the money within thirty (30) calendar days from the moment the right was exercised. This procedure will be regulated by the legal provisions and the guidelines of the administrative authority that has the competence to act in the matter. 

As a consumer you can notify us of your decision in accordance with the Complaints, claims, requests and suggestions procedure.

 

6.12. Payment reversal: When the payment of the products has been made through electronic procedures, the payment will be reversed, in accordance with the following: 

Applies when as a consumer you are subject to fraud, the payment corresponds to an unrequested operation, the purchased product is not received, the delivered product does not correspond to what was requested or is defective.

As a consumer, you must inform MATT SAS BIC within five (5) business days following the date on which you received notice of the fraudulent or unsolicited operation or that you should have received the product or received it defective or not corresponding to what requested, and you must return the product as it was received. 

In the case of fraud, you must notify the issuer of the electronic payment instrument used to make the purchase of the claim, which, together with the other participants in the payment process, will proceed to reverse the transaction to the buyer.

As a consumer, you must notify us of the facts and the request in accordance with the Complaints, Claims, Requests and Suggestions procedure. 

 

6.13. Changes by size and model: you must contact customer service via email 2g@matt.com.co or by phone +57 305 2167699 and specify the reason for the change. The product to be exchanged must be returned in good condition and you must cover the necessary shipping costs.

 

6.14. Warranty: To request the guarantee, the conditions of the product manufacturer will be taken into account, which will be available in the description of the product.

You may find third party links or third party platforms integrated into this website.
